ZortyrAI is an AI-powered customer service platform that enables businesses to automatically respond to customer messages on social media channels including WhatsApp, Instagram, and Facebook Messenger. The Service uses artificial intelligence to generate responses based on a business's knowledge base.
3. Account Registration
To use ZortyrAI you must create an account and provide accurate, complete information. You are responsible for: - Maintaining the security of your account credentials - All activity that occurs under your account - Ensuring your use of the Service complies with applicable laws - Keeping your contact and billing information up to date You must be at least 18 years old to create an account. One person or legal entity may not maintain more than one free account.
4. Subscription and Payment
ZortyrAI offers paid subscription plans billed monthly or annually. By subscribing you agree to: - Pay the applicable subscription fees as they come due - Provide valid payment information through our payment processor Stripe - Automatic renewal of your subscription at the end of each billing period You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial billing periods except where required by law. We reserve the right to change our pricing with 30 days notice. Price changes will not affect your current billing period.
5. Acceptable Use
You agree not to use ZortyrAI to: - Send spam, unsolicited messages, or harass customers - Violate any applicable laws or regulations - Impersonate another person or business - Transmit harmful, offensive, or illegal content - Attempt to reverse engineer or interfere with the Service - Violate the terms of service of connected social media platforms (Meta, WhatsApp, etc.) - Use the Service to collect sensitive personal data without appropriate consent We reserve the right to suspend or terminate accounts that violate these terms.
6. AI-Generated Content
ZortyrAI uses artificial intelligence to generate responses to customer messages. You acknowledge that: - AI-generated responses may occasionally be inaccurate or inappropriate - You are responsible for the accuracy of information in your knowledge base - You should monitor AI responses and update your knowledge base as needed - ZortyrAI is not liable for any damages arising from AI-generated responses - You are responsible for ensuring AI responses comply with applicable laws including consumer protection and advertising regulations
7. Social Media Platform Compliance
By connecting social media channels you agree to comply with the terms of service of those platforms including: - Meta Platform Terms for Instagram and Facebook Messenger integrations - WhatsApp Business Policy for WhatsApp integrations You are responsible for obtaining any necessary permissions from your customers to contact them through these channels. ZortyrAI is not responsible for violations of third-party platform policies.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy available at zortyrai.com/privacy. By using the Service you consent to our collection and use of data as described in the Privacy Policy. You retain ownership of your knowledge base content and customer conversation data. By using the Service you grant ZortyrAI a limited license to process this data solely to provide the Service.
9. Intellectual Property
The ZortyrAI platform, including its software, design, brand, and content, is owned by ZortyrAI and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission. The ZortyrAI name, logo, and brand are trademarks of ZortyrAI. You may not use our trademarks without prior written consent.
10. Limitation of Liability
To the maximum extent permitted by law, ZortyrAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages including lost profits, lost revenue, or loss of data arising from your use of the Service. Our total liability to you for any claims arising from these terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant that AI-generated responses will be accurate, complete, or appropriate for your specific use case.
12. Termination
You may terminate your account at any time by contacting us or through your account settings. We may terminate or suspend your account immediately without notice if you violate these terms or engage in conduct we determine to be harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination before permanent deletion.
13. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of material changes by email or through a notice on our platform at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the updated terms.
14. Governing Law
These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of Houston, Texas.
